Brett Kilbourne, Director of Regulatory Affairs at the United Power Line Council (UPLC) and a frequent guest on Etopia Media's Broadband over Power Line World, appeared again today to talk about new developments on the regulatory front, as they affect broadband over power line (BPL) deployment.

Included in that interview is a discussion of the Communications Assistance for Law Enforcement Act (CALEA), which requires network operators to provide access to the content of transmissions over their network to suitably authorized law enforcement personnel. Also discussed is the passage yesterday of SB5 in Texas, which, essentially, makes the Lone Star State safe for BPL, as opposed to the situation in Nebraska, where legislation to outlaw municipal broadband networks effectively also outlawed BPL deployment in the unicameral state.

During the interview Mr. Kilbourne points out that under the provisions of pending federal legislation, municipalities that build muni-broadband networks need to provide "open access" to private incumbent operators, even though those same private incumbent operators have just succeeded in their determined campaigns, at the U.S. Supreme Court (cable) and the Federal Communications Commission (telco) to bar competitive ISPs from their own infrastructure.
