Dave and Bekah Mays make fun of Christina Aguilera's "Genie in a Bottle," appearing on Google Video, but not yet on NBC's "The Tonight Show with Jay Leno"; is this fair use for purposes of parody, or copyright infringement?

young parodists create a copy more entertaining than the original

Thirteen-year old Dave May and his sister, Bekah, exemplifying the web-savvy creativity only hinted at in a recent Time magazine cover story entitled "The Multitasking Generation," have created a lip-synching, karaoke-like song parody of Christina Aguilera's "Genie in a Bottle," which to at least one reporter who'd never heard of the original, is, on its own, an entertainment worth watching.

the Mays' "Genie in a Bottle" parody didn't make the finals on "Google Idol"

Despite the high-quality of the Mays' performance in their parody of "Genie in a Bottle," they did not make the finals on Google Idol, itself a parody of "American Idol," but without Simon Cowell's snide remarks.

no word yet on the intellectual property rights (IPR) aspects of this phenomenon

Lawyers for Sony BMG Entertainment, who own the rights to "Genie in a Bottle," have not yet been heard from on the subject of the Mays' rendition of this work and their use of it in building their own careers.
