Rhode Island becomes 12th state to legalize medical marijuana, despite U.S. Supreme Court ruling in Raich v. Ashcroft saying federal prohibition of cannabis trumps state legalization of its use for medical purposes
Rhode Island has become the 12th state (counting the District of Columbia) to
legalize the medical use of marijuana and the first one to do so since the U.S. Supreme Court, on June 6, 2004, in
Raich v. Ashcroft ruled that, regardless of state laws legalizing the medical use of marijuana, possession of this substance remained a federal crime and the possessors of it, even if they were registered users of marijuana under state law, were still subject to federal prosecution on grounds of violating the federal prohibition.

Later on June 30, 2005, at 10:00 pm local (EDT) time, Representative Slater, the principal author of
2005 – H 6052, "The Edward O. Hawkins Medical Marijuana Act.", spoke with
American Politics Today, to tell listeners that the Rhode Island State Senate had voted, 28-6, to override Governor Carcieri's veto of the medical marijuana bill.
"We are half-way there. All we have to do is wait for the House to override and it will become law in the State of Rhode Island," Representative Slater said.
